Arbitration and Commercial Litigation

Represented clients in arbitrations before various institutional as well as ad hoc tribunals in disputes involving contentious and complicated issues inter alia relating to construction, government contracts, tender, telecom and power sectors.

Government Litigation

Handling complex disputes for government organizations on a day-to-day basis. The disputes are related to arrears of license fees, non-payment of statutory dues, regulation of civic amenities, service and post-service disputes, tender matters, leasing of properties, etc. In the past, he had served MMTC, SAIL and NDMC.

Regulatory Litigation

Regularly appear in cases where the client’s interests are threatened by regulatory action or faced with compliance issues and accordingly represent clients in various forums such as TDSAT, and APTEL.

Tax Litigation

Represented clients in both adjudications as well as appellate proceedings on a pan-India basis and handling cases from the tax assessing officer level right up to the Supreme Court in respect of all tax-related disputes including taxability, classification, valuation, exemption, deductions, treaty interpretation, refund and drawbacks.

 

White-Collar Crimes

Advised clients in defending themselves before investigating agencies such as the Central Bureau of Investigation (CBI), Enforcement Directorate (ED), Economic Offences Wing (EOW) and Directorate of Revenue Intelligence (DRI) in matters relating to tax evasion and investigations under the Prevention of Corruption Act and the Prevention of Money Laundering Act.

 

IPR Enforcement and Brand Protection

Regularly advise and appear for a multinational clients in criminal and civil IPR enforcement and brand protection matters to curb counterfeiting and piracy issues.

  • Advising and representing a global telecom major in a corruption case within the ambit of the infamous 2G Spectrum Scam

  • Advising an Indian coal mining company in a corruption case within the ambit of the infamous Coal Blocks Allocation Scam

  • Representing domestic and international clients in Courts with respect to disputes pertaining to contentious issues in commercial, criminal and tax litigation coupled with advisory on emerging areas of law

  • Specific exposure to contentious litigation involving disputed properties before the Debts Recovery Tribunal and National Company Law Tribunal

  • Servicing clients on tender disputes, telecom matters, trademark and design disputes, mining matters, electricity regulatory matters, information technology issues, rent control matters, tax liability disputes, white collar crimes

  • Successfully represented a global conglomerate with respect to the taxability of lifts and elevators before the Constitution Bench of the Supreme Court

  • Successfully represented a telecom conglomerate in getting a penalty of about Rs. 650 crores being set aside by TDSAT

  • Successfully represented a telecom group before TDSAT in obtaining additional start-up spectrum

  • Successfully represented one of the largest coal trading companies in a tender dispute before an Arbitral Tribunal

State of Tamil Nadu & Ors., (2014) 7 SCC 1 (Constitution Bench of Supreme Court)  Represented Otis Elevator Company India Limited before the Constitution Bench of the Supreme Court on the issue as to whether the installation and commissioning of lifts and elevators is a sale of goods or a works contract 

  • Board of Control for Cricket in India v. Cricket Association of Bihar & Ors., (2014) 7 SCC 383 (Division Bench of Supreme Court)  Represented Jaipur IPL Cricket Private Limited before the Supreme Court in the matter involving allegations of corruption/ fixing in the Indian Premier League 2013 

  • Commissioner of Income Tax v. Engineers India Ltd., (2014) 364 ITR 686 (Division Bench of Supreme Court) Represented Engineers India Limited before the Supreme Court in a matter regarding the interpretation of Section 260A of the Income Tax Act, 1961 

  • ITRON India Pvt. Ltd. v. CSII India Pvt. Ltd., Arb.P. No. 393/2021 dated 24.12.2021 (Delhi High Court)  Represented CSII India in an arbitration petition filed under Section 11 by ITRON India seeking the appointment of an arbitrator when CSII had already availed remedy under the MSMED Act. The Court held that MSMED Act would hold primacy as CSII had decided to avail remedy under a special law 

  • New Delhi Municipal Council v. Sarvesh Chand Gupta & Ors., C.R.P. 48/2017 dated 07.03.2017 (Delhi High Court) Represented NDMC in a matter regarding the filing of a Revision Petition against an Order declining condonation of delay in filing of Written Statement 

  • CSII India Pvt. Ltd. v. Telexcell Information Systems Ltd., IB-411/ND/2020 dated 05.10.2021 (NCLT, Delhi) Represented CSII India before the National Company Law Tribunal in a matter regarding non-payment of dues which were duly acknowledged on emails which the Tribunal held to be legitimate and payable and thus CIRP was ordered against the debtor company 

  • Bharti Airtel Ltd. v. Union of India, Pet. No. 198/2013 dated 09.12.2014 (TDSAT) Represented Bharti Airtel before the Telecom Disputes Settlement and Appellate Tribunal in a matter regarding the illegal imposition of penalty for offering subscribers local dialling services 

  • Dishnet Wireless Ltd. v. Union of India, Pet. No. 360/2012 dated 30.01.2014 (TDSAT) Represented Dishnet before the Telecom Disputes Settlement and Appellate Tribunal in a matter regarding allotment of additional spectrum beyond start-up spectrum
